1. Overview
This website is operated by ArpaSoft. Throughout the site, the terms “we”, “us” and “our” refer to ArpaSoft. By purchasing any service (Maintenance, Support, or Development) from us, you agree to be bound by the following Terms of Service.
2. Service Scope & Definitions
A. Maintenance Plans (Recurring)
- Scope: Maintenance plans cover technical updates, security monitoring, and backups as listed on the pricing page.
- “Tasks” Definition: Plans including “Small Tasks” refer to edits taking approximately 15-20 minutes (e.g., text changes, image swaps, plugin settings).
- No Rollover: Unused support tasks or hours do not roll over to the next month.
B. One-Time Fixes & Support
- Scope: Services like “Bug Fixing” or “Malware Removal” cover the specific issue diagnosed.
- Warranty: We provide a 30-Day Warranty on our fixes. If the exact same issue recurs within 30 days, we will fix it again for free.
3. Payments & Subscriptions
- Billing: Payments are processed securely via SureCart (using Stripe or PayPal).
- Auto-Renewal: Maintenance plans are subscriptions that automatically renew (monthly or yearly) until cancelled.
- Cancellation: You may cancel your maintenance subscription at any time via your Client Login dashboard. Cancellation stops future billing; your service will continue until the end of the current paid period.
4. Refund Policy (Digital Services)
Since we sell intangible digital services and expert time, our refund policy differs from physical goods:
A. Bug Fixing & Technical Support
- “No Fix, No Fee”: If we are unable to diagnose or resolve the issue you hired us for, you will receive a 100% Full Refund.
- Exclusions: No refunds are granted if the issue is fixed but you simply “changed your mind,” or if the issue was caused by a third-party hosting failure beyond our control.
B. Maintenance Plans
- No Partial Refunds: We do not offer pro-rated refunds for partial months used.
- Satisfaction Guarantee: If you are unhappy with the service, you may cancel anytime.
C. Website Development
- Deposits: For custom projects, the initial deposit is non-refundable once work has commenced, as this covers the reservation of our time and resources.
5. Client Responsibilities
To perform our services, you agree to provide:
- Access: Administrative access to your WordPress dashboard and/or Hosting Provider (cPanel/FTP).
- Truthfulness: Accurate descriptions of the issues faced.
- Ownership: You guarantee that you own the rights to all content (images, text) you provide for your website.
6. Limitation of Liability
ArpaSoft creates backups and takes all safety precautions. However, we are not liable for:
- Data loss caused by third-party hosting failures.
- Issues caused by plugins or themes updated by the client or other developers.
- Loss of revenue or profits due to website downtime.
7. Third-Party Tools
We may use third-party tools (e.g., Elementor, Divi, Wordfence) to build or maintain your site. While we ensure these are configured correctly, we are not the owners of these software and cannot guarantee their lifetime functionality if they are discontinued by their creators.
8. Changes to Terms
We reserve the right to update these Terms of Service at any time. Your continued use of our services constitutes acceptance of those changes.
